Basel Historical Museum General Terms and Conditions

1. Validity

The following general terms and conditions apply to all products (publications, merchandise, tickets and tours) that are sold via the Basel Historical Museum website: www.hmb.ch

The Customer’s placement of an order or downloading of a ticket indicates his/her acceptance of these Terms and Conditions.

1.1. Registration

To place an order, the Customer must first register as a customer or guest of Basel Historical Museum Online Shop. Customers may not use multiple user accounts with different user names or addresses. The customer or guest is granted access to the system upon completion of the registration process. Basel Historical Museum can revoke that access at any time and in such a case may block and delete the user name and matching password with immediate effect.

2. Parties to the contract

These General Terms and Conditions are issued by Basel Historical Museum, Steinenberg 4, Postfach, 4001 Basel, and apply to all purchases of publications, merchandise and tickets on the part of the buyer, hereinafter called the Customer.

3. Exclusion clause

Should any of the Customer’s own terms and conditions deviate from or contradict these terms and conditions, they shall be included in the contract only if confirmed in writing by Basel Historical Museum.

4. Conclusion of contract

The sole parties to the contract resulting from the purchase of publications, merchandise and tickets shall be Basel Historical Museum and the Customer, to the exclusion of all others.

The Customer commissions Basel Historical Museum with the performance of contract. Products are sold only to the end consumer.

For online purchases, the Customer’s clicking of the box “Confirm order” (or equivalent), which also confirms his/her acceptance of these General Terms and Conditions, constitutes a request to enter into a contract with Basel Historical Museum. The order is thus binding.

5. Payment

After placing his/her order for publications, merchandise and tickets, the Customer will be asked to pay by credit card (Visa, MasterCard, Amexco).

The price quoted for deliveries within Switzerland already includes Swiss value-added tax. For exports to other countries, the price quoted is the net price without value-added tax.

6. Dispatch and delivery

Publications and merchandise will be dispatched subject to the terms of delivery of Basel Historical Museum Online Shop. All orders are dispatched by Swiss Post subject to its terms and conditions. Basel Historical Museum shall not be liable for late deliveries or for any damage caused in transit.

Any import duty levied on goods imported into countries outside Switzerland shall be borne by the Customer. Import duty varies depending on the customs area. The Customer alone is responsible for the remittance of any customs duty and fees that may be due. Import duties are not delivery costs.

6.1. Tickets

Tickets are sent by e-mail as pdf-format print@home tickets attached to the order confirmation mail. The ticket entitles the holder to admission to the exhibition on the date printed on it. Tickets are no longer valid once the ticket holder has left Basel Historical Museum.

Printout tickets and electronic tickets stored in a digital wallet entitle the holder to admission to the museum. The order confirmation alone does not count as a ticket.

While each ticket can be printed out multiple times, it is identifiable by a bar code that can be used only once.

Tickets are checked by means of a bar code scanner. Visitors without a valid ticket cannot be admitted and must purchase a new ticket at the museum ticket desk.

The cost of a purchased admission ticket cannot be refunded. Lost or stolen print@home tickets cannot be replaced. Please keep your ticket in a safe place.

Ticket-holders who have purchased a reduced-rate ticket must be able to produce proof of their eligibility at all times. Reduced-rate tickets for which no proof of eligibility can be provided automatically become null and void.

7. Cancellations

A purchase once made cannot be cancelled.

8. Damages

8.1

Basel Historical Museum accepts no liability whatsoever for any loss or damage suffered by the Customer while availing him-/herself of the services specified here (including visits to the exhibition sites).

8.2

This limitation of liability shall not apply:

a) in the event of injury to life, limb or health resulting from gross negligence on the part of Canton Basel-Stadt or intent or negligence on the part of any one of its vicarious agents;

b) in the event of any other loss or damage resulting from gross negligence on the part of Canton Basel-Stadt or intent or gross negligence on the part of one of its vicarious agents.

9. Data protection

Our customers’ personal data are processed in accordance with the statutory data protection rules applicable to this contract. Customer data are collected, processed and used with the aid of automated methods and only to the extent necessary to the performance of contract. The Customer consents to the transfer of these data to subcontractors insofar as this is necessary to their performance of the contract entered into.

10. Final provisions

Swiss law only applies. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

Should any one of the terms of this contract be wholly or partially null and void or lose its legal force at a later date, the remaining terms shall retain their validity. In such a case, the contract will be adapted to allow the invalid clause to be replaced by whichever valid clause comes closest to the economic purpose that the parties to the contract intended, or would have intended had they been aware of the nullity of the clause actually chosen.

We reserve the right to amend and adapt these General Terms and Conditions as needed and acknowledge that any such changes shall apply only to future contracts.

Any disputes shall be settled in Basel.
